INTELLECTUAL PROPERTY & COPYRIGHT
All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on Yogastickmen.com® and all content located on the site shall remain vested in Yogastickmen.com®.
The licence for use of Yogastickmen.com® products is granted to the purchaser alone as specified by the licence agreement detailed below.
You may not share or otherwise distribute Yogastickmen.com® products with another user. If multiple users wish to use the product then each individual is required to purchase their own product to obtain a licence for use.
You may not share or otherwise distribute Yogastickmen.com® images or products as part of any trainning or teacher trainning manuals or courses under the standard licence for use. If you wish to use Yogastickmen.com® images or products as part of training materials email us for details of how to purcahse a COMMERCIAL LICENCE.
You may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use Yogastickmen.com® content in any way except for your own personal, non-commercial use.
You also agree not to adapt, alter or create a derivative work from any Yogastickmen.com® content except for your own personal, non-commercial use. Any other use Yogastickmen.com® content requires the prior written permission of Yogastickmen.com®.
You may not use Yogastickmen.com® images and products to produce any products, on any or part of any products and services or in any service designed to sell or induce sales of digial or "print on demand" products, including, by way of example only, postcards, mugs, t-shirts, posters, giclee prints, artwork and other items.
You may not use or display a Yogastickmen® image or product as part of or in connection with the production, promotion or marketing of your business (i.e logos and marketing collateral), any multimedia, digital, online,
audio-visual work or audio only work, including, without limitation, any documentary, news show, television program or film, in any media to support , enhance or promote your business.
Yogastickmen.com® images and products ARE NOT PERMITTED FOR USE in any digital media (i.e. internet, web based applications, computer based programs and applications, Apps or any digital or electronic media), or in or any products or commercial enterprises.
The images and logos identifying Yogastickmen.com® and their products and services are subject to copyright. Nothing contained in these terms shall be construed as conferring any licence or right to use any trade mark, design right or copyright of Yogastickmen.com® by any other third party except under the terms of the Licence agreement.
TERMS AND CONDITIONS FOR USE
A summary of how you can use Yogastickmen® products and images can be seen below. Full details can be seen in the Standard Licence Agreement which you are agree to as a condition of sale.
By this Agreement, Yogastickmen.com® grants you a personal, non-exclusive, non-transferable, right to use and reproduce Images in the following ways, subject to the limitations stipulated in Part II of the License Agreement
You may use the Yogastickmen® products and images as follows:
a) In paper presentations (specifically text and images) for educational and teaching purposes for classes only (NOT FOR TRAINING);
b) As documentation (i.e. in hardcopy) for education and teaching classes only e.g. lesson plans, course plans, hand outs for non-commercial use (as opposed to promoting the sale of the prints, posters, etc. containing the Images, or as part of training for paid courses) in quantities not exceeding one hundred copies (100) provided that such prints and/or posters and/or other reproductions combine words and an Image or Images;
In the event that you create a derivative work based on or incorporating one or more Images, all rights in and to such Images shall continue to be owned by Yogastickmen.com® subject to your rights to use such Image(s) pursuant to the terms and limitations summerised above and stipulated in the Standard Licence Agreement. All other rights in the Images and products are expressly reserved by Yogastickmen.com® for itself.
Yogastickmen.com® shall be under no obligation to refund your purchase fee for digital products under any circumstances. However, in the event that Yogastickmen.com determines that you are entitled to a refund of all or part of the product or software, such refund shall only be made to the Credit Card/ Bank or /Paypal Account originally used by you to purchase the product.
In order to comply with the European Union (EU) Directive on Distance Selling, our Terms & Conditions and Standard License must be agreed to before your order can be processed. These terms and conditions for the sale of goods and license conditions for use, govern any contract for sale that we jointly enter into and tell you the rights and obligations you have.
You may have other rights granted by law and these Terms and Conditions do not affect these. Your statutory rights as a consumer are not affected. Full terms and conditions can be seen in Standard Licence Agreement and a summary can be seen in the section above 'INTELLECTUAL PROPERTY & COPYRIGHT'.
IN THE EVENT THAT YOU BREACH ANY OF THE TERMS OF THIS AGREEMENT, YOGASTICKMEN.COM SHALL HAVE THE RIGHT TO TERMINATE YOUR USE OF ALL ITS PRODUCTS AND SERVICES WITHOUT FURTHER NOTICE. SUCH TERMINATION SHALL BE IN ADDITION TO YOGASTICKMEN.COM'S® OTHER RIGHTS AT LAW AND/OR EQUITY.
